Terms of Service

Welcome to the website of Four Deans Community Outreach Foundation (“the Foundation,” “we,” “us,” or “our”). By accessing or using our website, located at fourdeansfoundation.org (the “Site”), and participating in our programs, you agree to comply with and be bound by the following Terms of Service (“Terms”). Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using the Site, registering for programs or events, submitting forms, making a donation, or otherwise interacting with the Site or our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree to these Terms, you must not use the Site.

You also represent that you have the legal capacity to enter into these Terms, or that you are using the Site under the supervision and consent of a parent or legal guardian.

2. Eligibility

Our services are primarily designed for seniors, youth, and families residing in underserved communities throughout New York City. If you are under the age of 18, you may only use this Site and participate in our programs with the express consent and supervision of a parent or legal guardian.

3. Description of Services

Four Deans Community Outreach Foundation provides transformative programs and community support services focused on education, advocacy, and empowerment. Our offerings may include, but are not limited to:

  • Education Advocacy: GED, ESL, and CDA certification programs.
  • Housing Support: Placement assistance and advocacy for landlord-tenant issues.
  • Youth & Senior Programs: Youth LEAD initiatives and senior computer literacy.
  • Workforce Development: Resume writing, notary services, and job readiness.
  • Financial Literacy & Entrepreneurship: Budgeting, investment workshops, and corporate filing assistance.
  • Family Therapy: Counseling and mental health support services.
  • Other Related Services: Community outreach, referrals, and periodic events aligned with our mission.

Programs, eligibility requirements, schedules, locations, capacity, and availability may vary. We may modify, suspend, or discontinue any program or feature at any time.

4. Professional Disclaimers

A. Educational and Informational Purpose Only
The content provided through our financial literacy, entrepreneurship, and workforce development workshops is for educational and informational purposes only. The Foundation does not provide certified financial, legal, or tax advice. Participants should consult with a qualified professional before making significant financial or legal decisions.

B. Mental Health and Family Therapy
While we provide family therapy and mental health support, these services are not intended to replace emergency medical care. In the event of a mental health emergency or crisis, please contact 911 or visit the nearest emergency room.

C. Housing Advocacy
Our housing support services are intended to assist in navigation and advocacy. The Foundation is not a legal firm, a licensed real estate brokerage, or a landlord. We do not guarantee housing placement or specific legal outcomes in tenant-landlord disputes.

5. User Responsibilities and Prohibited Conduct

You agree to use the Site and engage with our programs in a respectful, lawful, and responsible manner. In particular, you agree to:

A. Provide Accurate Information
Provide true, accurate, current, and complete information when you submit forms, apply for programs, register for events, or communicate with us, and promptly update such information if it changes.

B. Respectful Conduct
Treat staff, volunteers, program participants, and community members with respect. Harassment, discrimination, threats, or disruptive behavior (online or in-person in connection with our programs) is not permitted.

C. Prohibited Conduct
Users agree not to:

  • Use the Site for any unlawful purpose or in violation of local, state, or federal law.
  • Submit false, misleading, unlawful, or harmful information through contact forms, donations, registrations, or program applications.
  • Attempt to interfere with the proper working of the Site, gain unauthorized access to systems or accounts, or bypass any security measures.
  • Upload, transmit, or distribute viruses, malware, or other harmful code.
  • Engage in any conduct that restricts or inhibits any other user from using or enjoying the Foundation’s services.
  • Use the Site to impersonate any person or entity, or misrepresent your affiliation with the Foundation.

We may suspend or restrict access to the Site or deny participation in programs to the extent permitted by law if we believe these Terms have been violated.

All content on this Site, including text, graphics, logos, images, audio, video, downloads, program materials, and software (collectively, “Content”), is owned by or licensed to Four Deans Community Outreach Foundation and is protected by United States and international intellectual property laws.

You may view, download, and print Content for your personal, non-commercial use only, provided you do not remove any copyright, trademark, or other proprietary notices. Any other use—including copying, reproducing, modifying, distributing, publicly displaying, or creating derivative works—requires our prior written permission.

“Four Deans Community Outreach Foundation” and related names, logos, and slogans may be trademarks or service marks of the Foundation and may not be used without permission.

7. Donations, Registrations, and Payments

A. Donations
All donations made to the Foundation are used to support our mission and programs. Unless otherwise required by law or expressly stated at the time of donation, donations are non-refundable. If you believe a donation was made in error (for example, an incorrect amount or an unauthorized transaction), please contact us promptly.

Donors should consult with their tax advisors regarding tax-deductibility. Any donation receipt we provide is intended for informational purposes.

B. Program/Event Registrations
Some programs, workshops, or events may require registration and may have capacity limits, eligibility criteria, waitlists, deadlines, or documentation requirements. Submitting a registration request does not guarantee placement. We may confirm, deny, or cancel a registration based on eligibility, capacity, safety considerations, or program rules, to the extent permitted by law.

C. Fees and Payment Processing
If any program or event includes fees, you agree to pay the disclosed amounts and any applicable taxes (if any). Payment processing may be handled by third-party processors; their terms and privacy practices may apply to your payment.

D. Cancellations and Refunds (Fees, If Applicable)
If a program or event fee is charged, any cancellation, rescheduling, and refund rules will be disclosed during registration or in program materials. If no refund policy is provided, fees are non-refundable unless required by law or we state otherwise in writing.

8. Disclaimers; No Guarantees; Limitation of Liability

A. Site and Services Provided “As-Is”
To the fullest extent permitted by law, the Site, Content, and our programs and services are provided on an “as-is” and “as-available” basis. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

B. No Guarantee of Outcomes
While we work to support community members through our programs, we cannot and do not guarantee any specific result or outcome, including (without limitation) employment, housing placement, certification, financial results, or any particular personal, family, or mental health outcome.

C. Limitation of Liability
To the fullest extent permitted by law, Four Deans Community Outreach Foundation, its directors, officers, employees, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or participation in our programs, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for any claims arising from these Terms or the Site shall not exceed the amount, if any, paid by you to the Foundation for the specific service or event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Four Deans Community Outreach Foundation from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the Foundation’s services.

10. Governing Law; Dispute Resolution

A. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

B. Informal Resolution First
If you have a concern or dispute related to the Site, a donation, a registration, or our services, you agree to first contact us and attempt to resolve it informally.

C. Venue
To the extent a dispute is not resolved informally and a legal claim is filed, you agree that any legal action or proceeding arising under these Terms shall be brought in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction and venue in those courts.

11. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective when posted to the Site with an updated “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
